“ZeteExpress” is a company incorporated under the laws of Bangladesh, (hereinafter referred to as
“as ZeteExpress) and offers diversified delivery and pick-up services with a focus on e-commerce transactions. This Agreement (“Agreement”) is an electronic contract between you and ZeteExpress, and this document outlines the terms on which ZeteExpress will provide the Services to you. You acknowledge that clicking the "I Accept" button, and subsequently accessing and using ZeteExpress's Services, constitutes an express acceptance of this electronic agreement between ZeteExpress and you. These Terms and Conditions may be changed from time to time and the effect of these Terms shall be deemed to be effective on you, from the date the Service is first offered to you.
You are alternatively referred to as "Client". Both you and ZeteExpress are hereinafter referred to individually as a "Party" and collectively as the "Parties". Scope of delivery service
The Client may access and use any of the following services provided by ZeteExpress (collectively, Fulfillment Services):
Delivery of goods from the client to its customer (forward leg delivery), which may include logistics for picking up the consignment from the client's designated premises, bringing it to ZeteExpress facility and finally sending it to the customer's customer
Collecting goods from client's customers and delivering to client's designated address (reverse pickup)
Cash handling for forward leg delivery which involves collection of cash at the time of delivery of goods to client's customers (COD service)
Client Obligations
The Client expressly understands that only you (i.e. the Merchant) have a direct contractual relationship with ZeteExpress and therefore all rights of claim and
liability rest solely with you. ZeteExpress has no responsibility/liability towards the end recipient and therefore will not entertain any claim or complaint brought
against it by the end recipients of the delivery. In such cases, the customer shall have sole responsibility to resolve such issues with the end recipient personally.
The Client shall ensure that the packaging of the Products is safe, proper and adequate to prevent normal transport and environmental hazards, including the
necessary invoices and documentation and to comply with applicable laws.
The Client shall ensure that the Products for delivery are kept ready for pick-up by ZeteExpress staff at the scheduled pick-up time, otherwise ZeteExpress staff will not wait at your location, and you may be charged the necessary fees for delivery. .
The Client shall ensure that the goods inside the package match the description of the goods in the outer packaging/documentation and to fulfill the same, true, true, fair, correct and realistic declaration of the description and price of the goods/goods handed over. Service. Please note that ZeteExpress will not provide any compensation for any loss sustained by the client, in case the actual contents of the package do not match the description of the contents provided by the client, in case of lost or damaged products. Such practices shall constitute a material violation of Company policies, resulting in ZeteExpress right to refuse service and prohibit the Client from using any of the Company's products and services.
Client shall not allow ZeteExpress (or its complementary personnel) to book/transfer or transfer any products which are prohibited, restricted, illegal, prohibited, stolen, infringing
Violation of the rights of any third party, dangerous or hazardous or currency of any tax law,
Bullion, correspondence and financial and security instruments ("Prohibited Goods").
Where requested by ZeteExpress, the Client shall, at its own expense, provide forecast reports, in the format and at the frequencies recommended by ZeteExpress,
which predict the likely need for the Services to be fulfilled by the Client. In addition, from time to time, ZeteExpress may request the Client to provide additional information
on an ad hoc or periodic basis, which may relate to the nature and amount of shipments that the Client will require to complete the Services.
ZeteExpress Obligations
ZeteExpress will provide fulfillment services with reasonable skill and care and in accordance with applicable law.
ZeteExpress shall be solely responsible for the selection, recruitment, hiring and supervision of its complementary personnel to ensure the provision of complete Services in accordance with the terms of this Agreement.
